Terms of service

Michael Francis Roses, LLLP, doing business as Francis Roses ("Francis Roses," "we," "us"), an Arizona limited liability limited partnership, sells the plants offered on francisroses.com on these Terms and Conditions. By placing an order you accept them, together with our Privacy Policy and our page Ordering, delivery and plant concerns, which form part of this agreement. If you do not accept them, do not order.

1. What you are buying

The Origin Release offers four rose varieties grown on our Arizona farm, Adventure, Le Temps des Cerises, Rallye des Gazelles and Sandrine Kiberlain, as field-grown, bare-root plants shipped dormant, without a pot or growing medium, with planting instructions. Plants are sold for garden use only. The varieties are protected by plant patents, plant breeders' rights and trademarks held by their breeders. By purchasing, you agree not to propagate the plant by any means (including cuttings, budding, grafting, division or tissue culture), not to sell, give away or distribute propagated material, and not to use the variety name on any plant you did not buy from Francis Roses or an authorized partner. Unauthorized propagation infringes the breeder's rights and is a breach of this agreement. Bare-root roses vary naturally in root form, cane shape and size, and dormant plants arrive without leaves or growth; such variation is not a defect.

The price is $65 per plant and includes shipping within the contiguous 48 United States. The amount shown at checkout is the amount you pay; no separate tax line is added. Ordering is open from November 12, 2026 at 11:00 a.m. Pacific time until November 14, 2026 at 11:00 a.m. Pacific time, or until a variety sells out. Quantities are limited and allocated in the order payment is completed; nothing short of a completed payment reserves a plant.

2. Orders and payment

Your order is placed, and your payment method is charged in full, when you complete checkout. Plants ship in January 2027. Our order confirmation email is our acceptance. All prices are in U.S. dollars. You confirm that the details you give us are accurate and that you are entitled to use the payment method.

We may refuse or cancel any order and refund it in full if the quantity exceeds what we have, the address is outside the contiguous 48 states, we suspect fraud or automated ordering, or the order breaches these terms. We may also cancel and refund in full if plants are lost before shipping to weather, crop failure, disease, or a regulatory or inspection hold. A full refund to the original payment method is our only obligation in those cases.

3. Shipping and delivery

We ship in January 2027 from Arizona by parcel carrier, one plant per box, to the address on the order, and email tracking when a box ships. If we expect shipping to run past February 28, 2027, we will notify you and offer a full refund in place of waiting; if you do not reply within 10 days of that notice, you accept the new date. Risk of loss passes to you when the carrier delivers to the address on the order.

You are responsible for an accurate, deliverable address and for being able to receive and plant dormant stock in January. A box returned as undeliverable is held for 14 days while we try to contact you; after that we refund the plant's price less the carrier's return cost, and the plant is not re-shipped. If tracking shows delivery but no box arrives, or no box arrives within seven days of the shipping notice, email us with your order number and we will open a trace with the carrier.

4. No change-of-mind returns; plant concerns

All sales are final. We do not accept change-of-mind returns or cancellations after an order is accepted, except where applicable law requires otherwise.

If a plant arrives damaged, fails to establish, or is not the variety ordered, the policy on our page Ordering, delivery and plant concerns applies and is incorporated here. In short: report shipping damage within seven calendar days of delivery; report failure to establish by June 30, 2027; report an incorrect variety during the plant's first flowering season after delivery. Each report must include your order number and the photographs that page describes. An approved concern is refunded to the original payment method for the price paid for that plant; replacement plants are not available and are not promised. Those reporting periods are conditions of the voluntary refund policy; they do not cut off rights that cannot be waived by law.

5. Descriptions and errors

Color, size, fragrance, hardiness and performance notes record our own field observations and the breeder's data; plants respond to climate, soil and care, and these notes describe what we have seen, not what your plant will do. If a price or description is published in error, we may correct it and either confirm the affected order at the correct terms with your agreement or cancel it and refund in full. An accepted order keeps the price you paid.

6. Warranty disclaimer and limitation of remedies

EXCEPT AS EXPRESSLY STATED IN SECTION 4 AND THE ORDERING, DELIVERY AND PLANT CONCERNS PAGE, PLANTS ARE SOLD "AS IS" AND FRANCIS ROSES DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. THE REFUND DESCRIBED IN SECTION 4 IS YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM CONCERNING A PLANT. FRANCIS ROSES' TOTAL LIABILITY FOR ANY ORDER SHALL NOT EXCEED THE AMOUNT PAID FOR THAT ORDER. FRANCIS ROSES IS NOT LIABLE FOR INDIRECT, INCIDENTAL OR CONSEQUENTIAL LOSS, INCLUDING LOSS OF OTHER PLANTS, LANDSCAPING OR REPLANTING COSTS, OR LOSS OF ENJOYMENT. THIS LIMITATION DOES NOT APPLY TO PERSONAL INJURY OR TO ANY LIABILITY THAT CANNOT BE LIMITED BY LAW.

7. Dispute resolution and governing law

These terms and every order are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Before starting any formal claim, you agree to email info@francisroses.com describing the problem and allow us 30 days to resolve it.

Any dispute not resolved that way shall be decided by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, in Maricopa County, Arizona or by video, under the Arizona Revised Uniform Arbitration Act and the Federal Arbitration Act. Claims are brought individually; neither party may bring or join a class, collective or representative proceeding. Either party may instead bring an individual claim in small claims court in Maricopa County, Arizona. You may opt out of arbitration by emailing info@francisroses.com within 30 days of your first order; opting out does not affect any other term. Judgment on the award may be entered in any court with jurisdiction.

8. Use of the site and intellectual property

You must be of legal age to order. You agree not to use automated tools to place orders or copy the site, not to interfere with it, and not to submit unlawful, infringing or harmful material through our forms. Forms do not subscribe you to marketing; Release Updates is a separate signup you can leave at any time. Information you submit is handled under our Privacy Policy. The text, photographs, film and design of the site belong to Francis Roses or are used with permission. Variety names marked ™ or ® are the trademarks of their owners, including Georges Delbard, Rosen Tantau, Interplant, Jan Spek Rozen and Roses Forever, used under license; a purchase conveys no rights in a name or variety, and the no-propagation undertaking in section 1 applies. Anything you send us (comments, photographs, suggestions) you license us to use in our business, and you confirm it is yours to give. Third-party sites we link to, including retail partners, are theirs, not ours.

9. General

If any provision is unenforceable, the rest stands, and the unenforceable provision is narrowed to the extent needed. Our not enforcing a term is not a waiver. These terms, the Privacy Policy and the Ordering, delivery and plant concerns page are the entire agreement for your use of the site and any order. We may revise these terms by posting a new version with a new effective date; an order already placed keeps the terms in force when it was placed.
